Trademark Registration in India: Process, Cost & Why It Matters

June 3, 2026 · 2 min read

Your brand name and logo are among your most valuable assets — but only if you own them legally. Trademark registration gives you exclusive rights to your mark and the power to stop copycats.

What Can Be Trademarked?

  • Brand and product names
  • Logos and symbols
  • Taglines and slogans
  • Distinctive shapes, sounds or colours (in some cases)

Trademark Classes

Trademarks are registered under one or more of 45 classes (1–34 for goods, 35–45 for services). You must choose the class(es) that match your business — for example, software falls under Class 9/42, while consulting services fall under Class 35.

Step-by-Step Registration Process

  1. Trademark search — check the IP India database to ensure your mark is available.
  2. File the application (Form TM-A) under the correct class(es).
  3. Once filed, you can use the ™ symbol immediately.
  4. The Registry examines the application and may raise objections.
  5. The mark is published in the Trademark Journal for opposition (4 months).
  6. If unopposed, the mark is registered and you receive the certificate — now you can use the ® symbol.

Cost & Timeline

Government fees are lower for individuals, startups (DPIIT recognised) and MSMEs than for large companies. Registration, if smooth, takes around 12–18 months, but your priority and ™ rights start from the filing date. A registered trademark is valid for 10 years and renewable indefinitely.

™ vs ®

  • — claimed but not yet registered (can be used immediately after filing).
  • ® — registered and legally protected (only after the certificate is issued).

Frequently Asked Questions
